Google has one more enemy in its plan to scan countless thousands of books without authors' consent --- Microsoft. A top Microsoft lawyer says that Google "systematically violates copyright" in its book-scanning scheme.
According to the Associated Press, Thomas C. Rubin, an associate general counsel at Microsoft gave a speech before the Association of American Publishers in New York in which he said that Google's book-scanning project violates copyright law, and cuts into the profits of both authors and publishers. Google has plans to scan books and making them searchable online, without asking permission from authors or publishers.
"Companies that create no content of their own, and make money solely on the backs of other people's content, are raking in billions through advertising revenue," he said, referring to Google.
Rubin had a receptive audience. The Association of American Publishers and the Authors Guild are both suing Google for copyright violations because of the search giant's book-scanning scheme.
Microsoft has its own plan for scanning books and making them available online. But Microsoft only scans books that are out of copyright, or books that publishers specifically let Microsoft scan.
Google, by contrast, scans in copyrighted books without author or publisher permission.
Ironically, Google has subpoenaed Microsoft in relation to the publishers' suit against it. But clearly, Microsoft will not be a friendly witness for Microsoft.
Microsoft has it right. Google is flat-out wrong in making these books available without permission of the copyright holders. Oddly enough, Google has agreed to take down videos from YouTube that violate copyright laws. But it doesn't have the same approach to books.
