Yet, oddly, I'm quite familiar with the surrounding facts of NeXT's ObjC extensions to GCC, and the legal issue was very clearly and explicitly the creation and redistribution of a derivative work in violation of FSF's copyright terms.
I've read some of Prof. Moglen's public writings on the broader question, and, despite great respect and appreciation for him generally, I couldn't help noticing that on that particular point he was long on advocacy and extremely short on legal analysis. If my overall understanding of the copyright framework for software is incorrect, I will end up being very gratified to learn better -- not to mention utterly astonished, and wanting a refund for thsoe classes in civil law.
