The general problem I find with your argument is that the cat is out of the bag. The term "Open Source" has been adopted in the language by many people who talk with varrying degrees of autority, whether they are directly involved with OSI or not. For whatever it is worth, OSI is no longer defining "Open Source" which is something I think they really encouraged and was a goal in their "marketing".
And now we are stuck with it. If Linus uses Bitkeeper, then it must be "OK" with Open Source, because Linus (insert Brooklyn based adjetive here) says so. Right?
right.
Nobody is running to OSI's website to see if it their official position or not. Of course, then we see a case like Nicholas Petreley shooting and Free Software with such a wide that he is busy shooting at Freedom under every rock, Free Software, Open Source be damned. But be clear about it. For millions of people Linus Tovalds is the face of "Open Source". If your going to argue otherwise by correctly pointing out the finer points of OSI membership, I'll agree with you, but that won't mean a darn thing to the public (or in political situations).
