I don't remember Koch being particularly benevolent to the homeless. Many of them WERE mentally ill. The Civil Liberty folks were right: You don't "PUT" sentient people anywhere they don't want to go. Cold or not. Without knowing more about that case, I'll presume the verdict was the right one.
By the way, is this the same Koch who kicked all those loons out of the hospitals to fend for themselves in the first place? What did he expect would happen to them upon release?
