Your question implies that they have some idea of what they're doing.
They don't.
And they're unrepentant liars. So this tells you nothing about whether or not they plan on suing Linux companies and users. Best to assume they plan on doing exactly that.
Fortunately they're not going to survive their encounter with IBM. And with some luck many will be doing prison time for securities crimes.
