The first panel will focus on proposed exemptions relating to audiovisual works and motion pictures on DVDs including:
· Audiovisual works on DVD protected by the Content Scrambling System (CSS) · Literary works (including computer software and databases), musical works, and motion picture works which are region encoded, and for which the nearly identical product except for being keyed for a region containing the United States does not exist for mass-market consumption within the United States. · Motion pictures and other audiovisual works restricted by access controls that limit access to and post-sale uses of the work, where circumvention of the technology allow a lawful possessor to use the work in a non-infringing way. · Foreign-language audiovisual works not available for sale in the United States but available for purchase outside the US on DVDs that are regionally encoded to prevent playback on DVD players purchased in the United States. Motion pictures and other audiovisual works restricted by access controls that tether the work to a specific device or platform, thereby preventing a lawful possessor from using the work on an unsupported system in a non-infringing way.
Due to the format of these hearings on particular topics/proposed exemptions, you should focus your testimony to these issues. You will also likely be limited to a 10 minute statement followed by questions to the panel from the Copyright Office panel.

I lead New Yorkers for Fair Use, an organization based in New York City, which advocates the publics stake in copyright issues. We are a grassroots organization, whose URL is http://fairuse.nylxs.com/, and affiliated with the New York GNU/Linux Scene, a Free Software educational society in New York City.
We would like to testify at the LOC's hearings for exceptions to the DMCA.
I would like to LOC to grant two exceptions, one for a media which can not be used without prior authorization with Free Software. And I would move for an excpetion of the Vital Book Product being used at the New York University College of Denistry. Both kinds of products have restricted the public to the point of undermineding their property rights.
In the case of media such as the standard DVD Movie, the in ability of reading these files under Free Software is destorys the essense of indiviudal property rights two owners of these disks, as they need a PREAUTHORIZED device to read the disk.
In the case of Vital Books, the disk is forced on the students with all their text books, and then it TURNS ITSELF OFF at the end of the semester, destroying the students property.
Both of these systems need urgent attention from the LOC.
