I don't understand how 3 is definitely happening. 3 only makes sense as a corollary to 2.
You don't fight for a name you have chosen to change.
You don't fight just to fight, that is what is turning people away.
Either you fight with a goal: 'We want the rights to NY Fairuse and we will do everything needed to get it' (not 'We want to smear brett and jay because they are jerks and we want the world to understand how badly we have been slighted') Or you decide: 'It's not worth the bickering, lets get on with business and do our work, let their reputation stand for itself, and let us focus on advancing ours'
And issue a stament such as: 'NYLXS would have liked to take Brett and Jay to court, and fight for the rights to NY Fairuse which we believe they fraudulently wrested from our control. But NYLXS believes that this would put too much stress on our organisation, and would take our focus and the public's interest away from the important actions we are planning. So, we have decided to change the name of our subcommitee NY FAIRUSE to BLEH to end the confusion which has resulted from B&J's fraulduent actions and hopefully to put that unfortunate episode behind us. Please let it be known that: NYLXS is in no way affiliated with a renegade group calling itself NYFU (and NY Fairuse) which is in control of the www.fairuse.org domain. The group formerly known as NY FAIRUSE and headed by Ruben Safir the sole founder of the original NY FAIRUSE and blah and blah and blah is now known as BLEH and can be found at bleh.nylxs.com'

1 and 3 don't mix.
