I see -- my mistake. That makes a lot of sense, actually. The one
thing really hurting their argument was the fact that cyber-squatting on
nylxs.org was so obviously wrong that they alienated anybody who could
think critically.
Now that this gesture was made to Marco, I suppose Jay feels free to use
NYFairUse as though he has a special dispensation. On the plus side, it
simplifies the dispute: The only injustice to correct is the theft of
NYFairUse. Of course that doesn't make it any less expensive.
Judging by his meeting announcement, I have to give Jay credit for his
Public Relations skills. He not only takes credit for things that he
didn't really influence, but he even mentions accomplishments that
weren't really accomplished. The whole Broadcast Flag issue is in limbo
not because of any appeals to the FCC but because Congress wants the
power to create Rights-Impeding technology for itself!
