The reports I've heard about the Rules Committee meeting indicates to me that you represented NYLXS fairly and with stength, rightfully, and correctly. However, the meeting failed in it's most primary misions.
At this point, if you think that you've acted in the best interest of NYLXS, I need to tell you this is not the case since then.
You failed. If you wanted to do what was in the best interest of NYLXS, you wouldn't have broadcast an internal board dispute to Stallman, or the hangout list, you would have stuck to our deadlines, and you would have gotten the Journals finished.
You would also just admit that NYLXS is being 'extorted', IN YOUR OWN WORDS at the board meeting, and further you will admit that my tactics is the ONLY reason why anyone is in negotiations now, and just admit that there is an obvious attempt to just further drag this out in the hopes that we will be worn out before Jay and Brett, which would allow then to steal our work.
Furthermore, you would admit what anyone looking in can plainly see, Brett is looking to drag this out past April 1st when the change in offices is to take place, like he has wanted to do from day one.
Talk about childishness Micheal. If I called you Childish or stupid, in a public forum, you'd be pretty annoyed, and with good reason.
I want to see if I can get something through that veneer you have...
NY Fair Use predates anything that Brett or Jay ever created, and was created by ME.
NYLXS was also created by ME, and has been supported by ME. It was designed from the start as the support system of NY Fair Use. That was it's direct purpuse... to lay down an economic, social, educational and politcal foundation for the activities of NY Fair Use. I KNOW, because I created them. NYLXS is NOT A LUG.
At this point, the entire effort looks like a failure, because this governing body of NYLXS seems to be unable to do even the most basic task as defend it's trademarks and copyrights, which is a fiduciary responsibilty of ANY OFFICER of ANY ORGANIZATION .... PERIOD.
I haven't made this harder... YOU HAVE.
Your contribution in settling this matter has been very negative at this time. It's been childish and your being a PIA. If you can not commit to protection of NY Fair Use and NYLXS right now, 100%, if you have any doubts about this whatsoever, you should act as an adult and remove yourself from any activities involved obtaining the domain back. And instead you should focus you energy on the two areas of your responsibility, both of which need your attention:
A - We need to sit down and make a membership list for the election.
B - We need the electronic form of the JANUARY Journal on Line, the HTML formating of the September Journal, and a plan for the March Journal
C- You need to present a detailed plan for the future of the Journal including it's subscription services, and printing plan. Otherwise, as one of our represetitives on the Rules Committee, I am directing you as the President of NYLXS that Wednesday is the deadline for all attempts to further negotiate this with either Brett or Jay. Further, the Rules Comittee is only empowered to arrainge for the final time and place and terms for the final negotiation or Binding Arbitration between the parties in disagreement. Any further negotiation about this is to be IN THAT MEETING, which the rules committee is setting up.
If you have more complaints against my evilness, as I'm sure you do, post them to boards private mailing list.
I'm sure this letter will create hard feelings, and for that I'm truly sorry, and apologies for in advance. But this is not a game. This organization has the potential, if not already become, one of the most important products of the Free Software community.
Furthermore, through education and it's political and economic initiatives it has, and can in the future, be the most important force for social change in the coming decades. It's foundation is on sound, well thought out Democratic principles which frees it from the limiting pitfalls of other organizations. It has a distribution of responsibility which gives nearly any member chance to participate and find personal satisfaction, even though a Democracy can be upsetting, difficult, and harder to lead, and requires more work.
It can NOT be made to bend to outside forces which wish to extort it, steal it's trademarks, or destroy it's works.
This board, now, faces a criticle point in the birth of NYLXS, and probibly it's most serious internal threat because our Trademarks and Copyright are being held illegally. And it's mettle is being tested.
It will not be allowed to die a still birth, and it will not buckle because of maliciousness attacks by selfish individuals outside the organization who have threatened it.
And I am persoanlly fed up with the finger pointing by the mebership.
Everything I've done, from DAY ONE has been open, and negoiated and worked through with board members. In these discussions and proceedings, I've made numerous and substantial concessions repeatedly on core issues and points, both in public, and on this list with the board.
My offers to Wynkoop and Sulzberger to exchange the NY Fair Use brand for a return of the NYLXS domain, copyrights and trademarks are dependent on them moving immediately, and as quickly as possible to settling this matter.
It is NOT THAT HARD. It CAN BE SETTLED in all of 10 minutes, ONCE THE DESIRE IS TO DUE SO ON THEIR PART IS THERE.
If not, we have legal rights to EVERYTHING I said, NYLXS, NY Fair Use, EVERYTHING. And they can and WILL be asserted.
It's dragged on for 6 months. It is NOT dragging on past Wednesday. After Wednesday, we are at an imposible IMPASS.
And even Wednesday is yet another comproime from Me to you, and from the organization to Bett and Jay. It is MORE than they are enititled to expect.
We have acted from the very beginning of this dispute in good faith, and no member of this board, or the organization has anything to be ashamed of, nor should anyone else outside of this organization looking in find weakness in.
Finally, this is the last message posted to hangout on this topic.
