There's actually quite a lot of them. And if you use a non-ICANN root, there's a lot more than that.
The problem here is that .com is the most common TLD, and .org is the most obvious TLD for a group like NYLXS to be in, and thus both should have been registered from the start. The decision not to register the .org was to make a statement, unfortunately the consequence of that decision ended up being what you have now. There's no point in debating the original decision however, because it's moot now.
At the end of this, a lot of things will get hashed-out which is good. If someone registers www.nylxs.nu and mirrors the site without permission, you'll know exactly what you're going to do about it.
