Please don't send me messages from Brett. It's so upsetting it upsets my whole day.

Fine

Vauge statement without evidence after we've examined it closely.
> >He sometimes even implied bad things about both > >myself and NYFU
More vaugness and ignors his real conduct while focusing on others. Standard bullying posture. The victem deserved to be hit I tell you.
He He He ... looked at me wrong.
> >to plant seeds for the weeds of strife that have been > >growing these past several months. I have said from the start that the so > >called problems that he has referred to were just a smoke screen for what > >ever private quarrel he has decided he has for me. i
Feeding forward with more manipulative assertions without evidence. Ending in a conclussion without supporting argumentive construction. Ending with a pointing of a finger at someone else for an action perpetrated by the abusers.
> >I have spoken to > >several people from NYLXS that wanted to speak to me about the "problem I > >had with NYLXS". In fact they all said they had no interest in any issues > >that had to do with things between me, and Ruben, or Ruben and New Yorkers > >For Fair Use.
Now this is just flat out wrong and has been the continual arguement by Wynkoop. He has continually denied the exitence of the NYLXS Board and Charter, or it's membership. This is very bad.
> > > >It has become clear that none of what Ruben has been doing for the last > >several months has been about me. It has been about New Yorkers For Fair > >Use and his desire to be single controlling person in that group. NYFU > >does not function that way and it never has.
Their is no evidence of Brett's involvement or ability to make any such statement, and the evidence overwhelming doesn't support this in any way.
NY Fair Use is my invention, and was run by me with as much of others input or lack of it as I deemed was good. Actions was directly my decision making process.
> > The closest Ruben ever got to > >being "President for Life" was rotating chair for some of the meetings.
The chair was never rotating. It was Joe Ercole. He would have known that if he'd been in any way involved at that time.
> > > >For anybody to believe the things Ruben has been saying about me, or New > >Yorkers For Fair Use, or nylxs.org over the last several months they would > >have to assume that there was never a very close friendship and even > >working partnership on various projects going back many years.
I don't know why you would say that. You certainly weren't like my friend Harry Torrez, of over 30 years of friendship, or like my Rav, who I speak to daily, or like other people in my community. I mean, clearly I tried to develope a friendship with Brett, but he refused to share, he would hold back information and complain that I shouldn't be earning money at things because because I'm asking him a question. He measured every act of 'kindness' in all the years I knew him, in a begrudging fashion, and then when I brought him in on projects, he would attempt to talk badly about me to the client, and tried to steal clients. I put up with lot a shit from Brett for a long time because of the positive side of his ledger and his potential as a good allay and friend. In the end, he just screwed everyone, and I really regret putting him in a position of trust.
> >In fact > >with some of his attacks against other members of New Yorkers For Fair Use > >one would have to assume that he had no relations or close friendships with > >any NYFU members either. It is either that, or everything Ruben says must > >be taken on blind faith.
Whatever. I run NY Fair Use (and NYLXS for another month), my friendship or lack of with people at NY Fair Use is not a question. There is, although you would think not as public as I am, limit on what is private to me, and a public life. It's not right to ask me to evaluate all my friendships and all relationships, and to ask people to make a persoanl evaluation of my life for the settlmenet of this matter.
There is enough of a written record of events to make clear the truth of the case, as well as the press legal rights for myself personally and for NYLXS, and NY Fair Use as my organization, which need not have examination if Ruben treates his friends well or not.
NYLXS will continue with the NY Fair Use brand, but is willing to bargain, until Friday.
A rules committee of Marco, Vinnie and Micheal has been started. A formal offer will be given Brett and Jay to come to the board this Monday to meet with a rules committee as a location of their choosing. They either come for the meet with the committee to discuss the cybersquating on our domain, or they don't.
If they don't, we move it to the beuarcaracies and the courts to enforce our tradmarks and brands. In fact, I think I found a doner willing to give NYLXS an capital it would require to defend the NYLXS trademark.

Right, As I didn't ALL the other times.
> > > >All of the "issues" have been because New Yorkers For Fair Use went ahead > >without him last September.
That is not at all founded in truth. I aked you to take over the day to day operations and instead you took the orgazition. In a word. I trusted you, and you screwed me. It's not the first time, nor was it the last time.
The last time I trusted you and you failed me was with the Unix 2 class. But you didn't just expose me that time, but screwed the entire organization, with a charter and a responsible government.

The abuser always loves it's prey.

Right. There is always something. Someone contct him and have him meet with the rules committee this week. Please don't let it go past this week.

Hmmm - I let this stand without comment.

Sounds like Stalin to me. If we jut remain quite and good, the rewards will be dished out by Commrade Wynkoop equitably and for the good of the party.
> >DRM is theft! We are the stakeholders! http://www.nyfairuse.org/ >
Ummm
DRM is theft! and We are the Stakeholders! was created my me. I'm revoking the right of any organization affiliated with Wynkoop to use those phrases without my permision unless they pay NYLXS for the priveledge.
The use of the expression in the context above is a commercial usage designed to promote a cybersquating website.
This will be included in damages.
BTW - NY Fair Use is at http://fairuse.nylxs.com
Brett, you should punt, because not only is an antagonistic stand against the NYLXS board and Government counter productive, but your exposing yourself further and reducing your ability to do advocacy in the community in the future.
And then you are going to loose both the NY Fair Use Brand, and the NYLXS.org domain. And then your going to wind up being personally responsible for the court fees and costs.
We've offered you a MORE than fair deal, in addition to already creating an outline for a legal settlment. You should meet with the rules committee and agree to binding arbitration on this matter.
