Jay,
I think what Ruben is offering is fair. Neither you nor Brett has any right to the NYLXS.org domain. You have to give it back to the organization. If you don't want to give it to Ruben personally then pick some other member of NYLXS to give it to. But one way or another it's got to come back to the organization. I agree with Vin's assessment, Brett has been to say the least, shady, when it comes to this matter. I have not always agreed with how Ruben has handled the dispute, but Brett is definitely wrong to keep the domain name hostage. If he and Ruben have some beef, and if their is some beef with NY Fair Use that is one thing, but there is no reason to punish members of NYLXS that have nothing to do with either dispute. Just do the right thing and give the name back and settle any problems you may have with Ruben separately.
