Linux is an OS, and so is Sun, and AIX, and Windows XP. What makes Linux unique? Linux is unique because it was created to ensure it's users freedom now and in the future. So from the start, Linux has political implications. You are correct that certain political freedoms permit it to be created. These are common freedoms which are a cornerstone of a free government.
I doubt either Linux or Western libral government can survive the DMCA.
